Senator Flake Votes No on Marketplace Fairness Act

Could Lead to Burdensome Compliance Costs for Small Businesses; Legislation Should be Subject to Amendment Process

WASHINGTON, D.C. – United States Senator Jeff Flake (R-AZ), today voted against S. 743, the Marketplace Fairness Act.

“I recognize the challenge brick and mortar retailers face when internet-based competitors are not required to collect sales taxes, but this version of the bill has potentially cumbersome and expensive consequences.  For example, given that every state and tribal organization could impose different rules of what is and what is not taxed, retailers who conduct even part of their business online could face costly and far-reaching compliance burdens. Further, this bill would open the door to audits and other enforcement actions by states in which these businesses have no presence,” said Flake.

“Neither committee consideration nor an open amendment process were permitted for this bill, which would have allowed for the opportunity to address these concerns. As it is written and because it cannot currently be amended, I voted against the bill.”
